Agreement *

Please check each check box indicating you have read each section of the agreement:

(1) This agreement is between the Client (named above) and Stephen Cihanek (hereafter "The Videographer") for the fee of $500.00 (five hundred dollars), The Videographer agrees to provid videography service at the time and location above.

(2) Regarding payments: The Client agrees to pay, in full, the amount listed above to The Videographer by the event date.

(3) Unless otherwise specified, it is understood that any and all rights to raw and edited video content, thereof shall remain the property of The Videographer, and may be used for advertising, display or any other purpose thought proper by The Videographer. The provided video may not be copied for distribution or broadcast or posted digitally online due to possible copyright restrictions on music captured during the event.

(4) If The Videographer cannot perform this Agreement in whole or in part due to a fire or other casualty, acts of God or nature or terror, or other cause beyond the control of the parties or due to The Videographer's illness or injury, then the Videographer will make every effort to secure a replacement Videographer. If the situation should occur and a suitable replacement is not found, The Videographer shall return all fees to the Client but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event that video content is damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of The Videographer. The Client agree that an entire event cannot be replicated, reenacted or repeated for the purpose of a re-shoot and limits The Videographer's liability to the amount paid under this contract.

(5) On signing of this agreement by both parties will reserve the time agreed upon and will not make another reservation for the specific time frame. In the event of a cancellation by the Client, The Videographer will refund any payments made to date if notified more than 60 days prior to the Event date and he will refund 50% of any payments made to date if notified more than 30 days prior to the Event. No refund will be given if notified less than 30 days prior to the Event. The Videographer must be notified by email or USPS.

(6) I, the undersigned Contracting Party, hereby warrant that I am competent to contract in my own name. I confirm that I have read the herein agreement prior to its execution and I am fully familiar with the contents thereof. This agreement shall be binding upon us and our legal representatives and assigns.
